Terms & conditions

You must be at least 16 years old to create an account, and at least 18 years old (or have the permission of a parent or legal guardian) to place an order. You are responsible for the accuracy of the information you give us, for keeping your password secure, and for all activity that happens under your account.

We may suspend or close an account that is used fraudulently, that breaches these Terms, or where we are required to do so by law.

We sell physical card games. Product images, artwork and component photography are illustrative; final printed products may vary slightly in colour, finish and packaging. Player counts, play times and age ratings are recommendations, not guarantees.

Games shown as "coming soon" or "fulfilling soon" are not available for immediate purchase. Where we link to a third-party crowdfunding campaign (such as Kickstarter), that purchase is made with that platform and the campaign's own terms apply, not these Terms.

All products are subject to availability. If a game becomes unavailable after you order, we will contact you and offer a replacement, a backorder or a full refund.

Product listings are an invitation to treat, not an offer. Your order is an offer to buy. A contract is only formed when we send you an order confirmation and payment has been successfully processed. Until then we may decline or cancel any order, in whole or in part.

We may cancel an order where the product is unavailable, where there has been a pricing or description error, where we suspect fraud or reselling in breach of these Terms, or where we cannot deliver to the address given. Where we cancel, we refund you in full.

All prices are shown in Australian dollars (AUD) and include GST where applicable. Shipping is charged in addition and shown at checkout before you pay. The price shown at checkout is the price you pay for that order; we may change prices at any time for future orders.

Payments are processed by our third-party payment provider. We do not receive or store your full card details. You warrant that you are authorised to use the payment method you provide. If a payment is reversed, charged back or fails after dispatch, you remain liable for the amount owing.

Obvious pricing errors are not binding on us. Where a price is clearly wrong, we will contact you before dispatch and you may confirm at the correct price or cancel for a full refund.

We currently ship within Australia only. Orders are shipped within 2 business days of payment clearing, from Forestville, NSW. Delivery timeframes quoted on the Site are estimates provided by our carriers and are not guaranteed.

Title and risk in the goods pass to you on delivery to the address you provide. It is your responsibility to give a correct and complete delivery address; re-delivery costs for incorrect addresses may be charged to you. If a parcel is lost or damaged in transit, contact us and we will investigate with the carrier and replace or refund your order.

In addition to your legal rights, we offer a 60-day satisfaction promise: if a game isn't fun, email us within 60 days of delivery and we will refund it, even if it has been opened and played. Refunds are made to the original payment method within 10 business days of us approving the return. You are responsible for return postage on change-of-mind returns unless we agree otherwise.

If a game arrives faulty, damaged or with missing components, tell us and we will replace the components or the game, or refund you, at no cost to you.

Nothing in these Terms excludes, restricts or modifies your rights under the Australian Consumer Law. Our goods come with guarantees that cannot be excluded. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage, and to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Retail orders are for personal use. Purchasing for commercial resale or distribution requires a wholesale account and separate written terms — please use our wholesale enquiry form. We may cancel retail orders that we reasonably believe are placed for resale.

Applying to the play tester pool does not guarantee selection. Testers must be 18 or older, reside in Australia, and accept the play tester non-disclosure agreement presented at application, which is signed electronically on submission and binds the tester on behalf of their whole play group. Prototypes remain our property and must be returned using the prepaid postage we provide. Participation is voluntary and unpaid, and any feedback you give us about our games becomes our property.

When you post a review or other content on the Site, you confirm it is your own honest opinion and does not contain unlawful, misleading, defamatory or offensive material. You grant us a perpetual, royalty-free, worldwide licence to use, reproduce and display that content in connection with our products and marketing. We may edit, decline to publish or remove content that breaches these Terms.

All game names, artwork, rules, text, photography, logos and Site content are owned by or licensed to Mad Fun Games and are protected by copyright and trade mark law. You may not copy, reproduce, adapt, distribute, print or commercially exploit any of it without our prior written permission.

You must not misuse the Site: no attempting to gain unauthorised access, scraping, interfering with its operation, introducing malicious code, or using it for any unlawful purpose. We may restrict or withdraw access where we reasonably believe you have done so.

To the maximum extent permitted by law, and subject always to the Australian Consumer Law, our total liability arising out of or in connection with an order or your use of the Site is limited, at our option, to replacing the goods, supplying equivalent goods, or refunding the price you paid. We are not liable for indirect or consequential loss, loss of profits, or loss arising from events outside our reasonable control.

We collect and handle personal information in accordance with our privacy policy, which forms part of these Terms.

We may update these Terms from time to time. The version published on the Site when you place an order is the version that applies to that order. Material changes take effect when posted here.

These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that state. If something goes wrong, please contact us first — we would much rather sort it out directly.
